Please Vote For the Below Meadowview Forum COALITION of Candidates if you want to effect change, accountability, transparency, and approachability without condemnation. See the tab below or above for Candidate's statements and pictures. Let's get them on the Board and ensure change. If you had an issue with the "Proposed Rules and Regulations" then these are the candidates you should vote for!

VISION:
An HOA BOARD OF DIRECTOR should represent YOUR PROPERTY RIGHTS, YOUR INTERESTS, YOUR CHOICES, and ensure BALANCE and TRANSPARENCY.
BOARD OPENINGS:
Your HOA Will have at minimum 3 Board openings. Two additional seats are open but there was no appointment, until just recently, before the election. Per Bylaws, where this occurs, the annual meeting is the forum where unappointed seats go to the vote of the membership at the annual meeting; but, the Board unilaterally moved that meeting beyond the statutory date and apparently took that vote away.

Below are the Coalition of over 400 Meadowview residents' CANDIDATES. Three of those stepped up and out with overwhelming concern for their community--like you--and are endorsed by your neighbors for CHANGE and TRANSPARENCY. They are formidable, they are willing, and they are able to step up and say "no" to the current agenda. They are YOU, and want to effect change by making a difference. Vote for each candidate below and make your voices heard--approved and vetted by your neighbors to get the job done, and RESTORE Meadowview to a place that is approachable and caring of your voice without judgment or retribution--or as we have recently seen without, aggression.

ADHERENCE TO FIDUCIARY DUTIES
FIDUCIARY DUTIES: To the Membership
The three fiduciary duties board members of an HOA should uphold:
(1) the Duty of Care,
(2) the Duty of Loyalty, and
(3) the Duty to Act Within the Scope of Their Authority.
HOA Board Members' Duty of Care:
To meet the duty of care, an HOA board member must make informed decisions, which might require a bit of research before you act or vote on an HOA matter. For example, before promulgating or fining a homeowner for a rule violation, you must familiarize yourself with the association's CC&Rs and Bylaws, not act arbitrary or capricious, and the understand the details of the situation--such as by talking with the homeowner. HOA board members must also act in a prudent and reasonable manner, basically using sound business judgment and avoiding arbitrary or capricious actions. For example, you can't issue a fine against a homeowner for painting a home red just because you don't like that color, if this is not a violation of association rules about house paint color.
HOA Board Members' Duty of Loyalty:
The duty of loyalty requires that HOA board members act fairly, in good faith, in the interest of, and for the benefit of, the HOA as a whole, rather than making decisions based on any personal interest or gain. HOA board members should also avoid acting where there is a conflict of interest. For example, a board member who is helping select landscapers for the property should not steer contracts for landscaping to friends, business associates, or family members. Additionally, an HOA board member must protect members' confidentiality, and not divulge information provided in confidence. For example, if a home owner confides in a board member about his impending home foreclosure in order to arrange a payment plan for HOA dues, the board member should not disclose the information to a friend or neighbor.
HOA Board Members' Duty to Act Within the Scope of Authority:
This duty requires the HOA board to perform the duties it's obligated to carry out, but prohibits the board from making decisions or acting on matters without the authority to do so. The authority of an HOA comes from its obligations under state laws, as well as the authority granted to it in the development's governing documents.

PURPOSE: This is a request for Judicial Review of Meadowview ("MV") governing actions by the Board of Directors and FSResidential Management not in compliance with state legislative laws and AB mandates (on multiple occasions), which subject the membership to liability, fines, and violations by the state; as well as denies the membership the right to vote on important/critical membership issues as required by the MV Bylaws. MV is a corporate entity. The forum for Judicial Review, per Davis-Stirling Act (“Act”) and state law, is via a Small Claims filing to obtain access to a Judge for this review. That is, this is the most immediate way the Act has provided to have a judicial officer review and protect the corporation from harm.

We are over 400 strong in a community of 900 lots. Had it not been for all of the dedicated volunteers and supporters like YOU opposing the "The Proposed Operating Rules" we would not have been successful in repealing the current Board's document reflecting overly invasive restrictions to property rights that are guaranteed by the CC&R's and Bylaws of Meadowview.
Now we move forward to effect change: creating and electing a new compliant HOA Board that is approachable, sensitive to your needs, strictly abides by new legislative rulings, and that welcomes your input without reproach, disrespect, or retaliation. The Forum will offer you a vehicle to express your opinion (anonymously, if desired) and fight for your property rights. We now enter a new phase and opportunity for new governance, and invite your opinions for bettering our community.
